Does a badge supersede your rights?

Before you got your driver’s license, you learned that being in control of a motor vehicle could be extremely dangerous. And while you know you could face serious consequences for driving recklessly, exceeding the speed limit or operating a vehicle under the influence (OVI), are you familiar with your rights during a traffic stop?

Getting pulled over by a law enforcement officer (LEO) can be intimidating under any circumstances. And if a LEO stops your vehicle after you consumed alcohol or drugs, it may be even scarier. But regardless of your circumstances, you have rights.

You have rights during your interaction with the police

Sometimes you might feel like there is a fine line between what you may and may not do during your interaction with the police. You should always treat officers with respect and answer their questions honestly. At the same time, you also have the right to be treated accordingly.

During a traffic stop, you have the right to:

  • Inform the LEOs that you choose to remain silent
  • Refuse to consent to a search of your vehicle and personal belongings
  • Request officers’ names and badge numbers
  • Refuse to submit to a chemical or physical test
  • Ask for attorney representation if a LEO places you under arrest

While understanding your rights is important, you should also remember that resisting arrest, provoking an officer or trying to escape the police could potentially escalate a situation.

However, if you believe the police pulled you over unlawfully or violated your rights during your traffic stop, you may explore your options for fighting your charges.
